Pro-LGBT Equality / Inclusive Bills:

 

AB 633 (Ammiano) - Require the California Department of Corrections and Rehabilitation (CDCR) to consider sexual orientation and gender identity when classifying inmates in order to prevent sexual violence. (Note: Re-introduction of AB 382 that was vetoed.)

Status: Vetoed by the Governor (09/23/2010).

 

AB 1451 (Ammiano) - Establish the Local Government Identification Act, which would authorize counties to issue local identification cards (local ID cards) to persons who can provide proof of identity and proof of residency within the county. (Note: Re-introduction of AB 772 that was vetoed.)

Status: Vetoed by the Governor (09/22/2010).

 

AB 1680 (Saldaña) - Prohibit contracts from requiring a person to waive their legal rights and procedures under the civil rights laws dealing with bias-motivated violence and hate crimes.

Status: Vetoed by the Governor (09/30/2010).

 

AB 1878 (Lieu) - Require the state to add questions about sexual orientation, gender identity and domestic partnership status in the voluntary demographic section of California’s government forms.

Status: Held under submission in Assembly Appropriations Committee.

 

AB 2055 (De La Torre) - Specify that, for purposes of those provisions governing eligibility for unemployment benefits, "domestic partner" also includes a person to whom domestic partnership, as described, is imminent.

Status: Passed the California Legislature and approved by the Governor.  Chaptered by the Secretary of State - Chapter   590, Statutes of 2010 (09/30/2010)

 

AB 2199 (Bonnie Lowenthal) - Repeal section of the California Welfare and Institutions code that instructs the State Department of Mental Health to conduct research into the “causes and cures of homosexuality.”

Status: Passed the California Legislature and approved by the Governor.  Chaptered by Secretary of State - Chapter 379, Statutes of 2010. (09/27/10).

 

AB 2340 (Monning) – Provide employees in California the right to take three days of unpaid time off in the event of the death of certain relatives including same-sex spouse or domestic partner.

Status: Vetoed by the Governor (09/25/2010).

 

AB 2364 (Nava) - Revise various provisions governing eligibility for unemployment compensation benefits to specify that a claimant is eligible for benefits where he or she left an employer’s employ to protect his or her family from domestic violence abuse.

Status: Passed the California Legislature and approved by the Governor.  Chaptered by Secretary of State - Chapter 678, Statutes of 2010. (09/30/10).

 

AB 2700 (Ma) - Create a consolidated form and procedure to dissolve both a civil marriage and domestic partnership at the same time.

Status: Passed the California Legislature and approved by the Governor.  Chaptered by Secretary of State - Chapter 397, Statutes of 2010. (09/27/10).

 

AB 2735 (De León) - Exclude from property tax reassessment a transfer of co-tenancy interest in a principal residence if the principal residence was owned by two individuals and was transferred to one of those individuals upon the death of the other, with the survivor obtaining sole ownership of that property.

Status: Held under submission in Assembly Appropriations Committee.

 

AJR 15 (De León) – Urge Congress and President Obama to sign, the Uniting American Families Act, which would extend immigration rights to bi-national same-sex couples.

Status: Passed the California Legislature.  Chaptered by Secretary of State - Res. Chapter 60, Statutes of 2010 (07/07/2010).

 

AJR 19 (Brownley) - Urge Congress and the President of the United States to repeal the discriminatory Defense of Marriage Act.

Status:  Passed the California Legislature.  Chaptered by Secretary of State - Res. Chapter 120, Statutes of 2010 (09/07/2010).

 

AJR 29 (Feuer) - Promote tax equality for same sex couples by requesting that the IRS defer to California law on treatment of community property belonging to registered domestic partners and same-sex spouses.

Status: Passed the California Legislature.  Chaptered by Secretary of State - Res. Chapter 102, Statutes of 2010 (08/23/10).

 

HR 30 (Ammiano) – LGBT Pride Month Resolution.

Status:  Adopted in the Assembly, 50 – 1 (06/14/2010).

 

SB 543 (Leno) - Permit youth ages 12-17 to consent to mental health treatment without parental permission if the attending professional believes the youth is mature enough to make the decision or if the youth would present a danger of serious physical or mental harm to self and others without the services.

Status: Passed the California Legislature and approved by the Governor.  Chaptered by Secretary of State - Chapter 503, Statutes of 2010. (09/29/10).


SB 906 (Leno) - Specify that no priest, minister, rabbi, or authorized person of any religious denomination would be required to solemnize a marriage that is contrary to the tenets of his or her faith. The bill would state that any refusal to solemnize a marriage under that provision shall not affect the tax exempt status of any entity.

Status: Vetoed by the Governor (09/30/2010).

 

SJR 9 (Kehoe) – Memorialize Congress and the President of the United States to repeal the U.S. military’s discriminatory “don’t ask, don’t tell” policy.

Status:  Passed the California Legislature.  Chaptered by Secretary of State - Res. Chapter 29, Statutes of 2010.

 

SJR 28 (Kehoe) – Memorialize the Congress and the President of the United States to enact legislation to have the 2020 Census gather data on sexual orientation and gender identity.

Status: Senate concurred to Assembly amendments, 21-8 (08/25/2010).  To enrollment.

 

SR 44 (Kehoe) – LGBT Pride Month Resolution. Declaring June 2010 as LGBT Pride Month.

Status:  Adopted by the State Senate, 25 – 9 (06/03/2010).

 

SR 51 (Leno) – Resolution that makes a correlation between some United States based religion and sexual orientation discrimination directed at the lesbian, gay, bisexual, and transgender community in Uganda, and commends the work of Right Reverend Christopher Senyonjo to promote LGBT equality in Uganda.

Status: Adopted by the State senate, 21-14 (08/30/2010).

 

Health and HIV/AIDS –Related Issues:

 

AB 1701 (Chesbro) - Establish, indefinitely, the Disease Prevention Demonstration Project (DPDP), which permits cities or counties to authorize licensed pharmacists to sell or furnish 10 or fewer hypodermic needles or syringes to a person for use without a prescription, as specified.  Specifically delete the December 31, 2010 sunset date.

Status: Passed the California Legislature and approved by the Governor.  Chaptered by Secretary of State - Chapter 667, Statutes of 2010. (09/30/10).

 

AB 1858 (Blumenfield) - Permit the Department of Public Health (DPH) to authorize clinics or other entities to provide hypodermic needle and syringe exchange services in any location where DPH determines that the conditions exist for the rapid spread of HIV, viral hepatitis, or any other potentially deadly or disabling infections that are spread through the sharing of used hypodermic needles and syringes.

Status: Vetoed by the Governor (09/30/2010).

 

AB 2590 (Bonnie Lowenthal) - Authorize the California Department of Health Care Services (DHCS) to share information under specified circumstances with a contractor providing disease management services to Medi-Cal beneficiaries who are HIV-positive or who have been diagnosed with AIDS..

Status: Held under submission in Assembly Appropriations Committee.

 

AJR 13 (Ammiano) - Request that the President of the United States encourage, and that the Secretary of the United States Department of Health and Human Services adopt, policies that repeal the current discriminatory policies of the FDA regarding blood donation by men who have sexual relationships with men (MSMs).

Status: Passed the Senate, 22-8 (08/25/2010).  To Assembly for enrollment.

 

SJR 14 (Leno) - Urge the President and Congress of the United States to take specified positive federal actions relating to the use of marijuana for medical purposes.

Status:  Failed passage in the State Assembly, 37-29 (08/30/2010).

 

Other Bills of Interest:

 

AB 967 (Ma) - Authorize a mayor of a city, while that person holds the office, to solemnize a marriage ceremony.

Status: Passed the California Legislature.  Vetoed by the Governor (07/19/2010).

 

AB 2600 (Ma) – Re-introduction of AB 967 with urgency.

Status: Passed the California Legislature and approved by the Governor.  Chaptered by Secretary of State - Chapter 268, Statutes of 2010. (09/24/10).
